Welcome to Hexazn! By using our services, you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully. If you do not agree to these terms, you may not use our services.

1. Introduction

Hexazn is an independent web hosting and infrastructure service provider offering a wide range of hosting solutions. By signing up for our services, you agree to these Terms of Service (ToS), our Acceptable Use Policy (AUP), Privacy Policy, and Client Verification Policy.

2. Service Agreement

2.1 Scope of Services

Hexazn offers shared hosting, VPS, unmanaged VPS, BDIX hosting, dedicated servers, BDIX dedicated servers, BDIX colocation, and other web services. The services you purchase will be detailed in your selected plan.

2.2 Service Delivery

Services are typically activated instantly, but dedicated server provisioning may take 24–48 hours after payment confirmation.

Clients are responsible for providing accurate and complete information during sign-up to avoid delays or service issues.

2.3 Uptime Guarantee

We offer a 99.9% uptime guarantee for shared hosting, VPS, and Dedicated Server. Downtime due to scheduled maintenance, DDoS attacks, or natural disasters is excluded.

2.4 IP Address Policy

Requests for IP changes on services will only be considered if legitimate technical issues are identified by Hexazn. If no such issues are found on the server or provider side, Hexazn reserves the right to refuse the IP change request.

Please note: If the issue is not related to routing, BGP, or other technical faults, but rather due to a specific website blocking your IP address for abuse or policy violations, this does not qualify as a valid reason for an IP change.

3. Payment Terms

3.1 Billing Cycle

Services are billed monthly, annually, or per the selected plan.

Payments must be made in advance for each billing cycle.

3.2 Refund Policy

Shared hosting and unmanaged VPS services are eligible for a 7-day money-back guarantee.

A partial refund will be applicable for Dedicated Servers and can be claimed within 7 days.

Domain registration, SSL certificates, IP PBX, and colocation services are non-refundable once activated.

Refunds are void in case of AUP violations.

Refunds are void in case of failed to complete KYC verification.

3.3 Late Payments

Accounts unpaid after the due date may be suspended after 3 days.

Termination may occur after 7 days of non-payment.

3.4 IP Change & Refund Policy

Requests for IP change on services will only be considered if there are legitimate technical issues defined on 2.4 identified by Hexazn. If no issues are found on the server/provider end, Hexazn reserves the right to refuse the IP change request.

If a user requests a refund on the basis of a denied IP change where no provider-side issue exists, the refund will not be processed.

3.5 Multiple IP

Users who require multiple IP addresses for legitimate business purposes on Linux VPS may submit a request to Hexazn Support.

• The request must clearly state the purpose and justification for additional IPs.
• Hexazn reserves the right to verify and approve requests based on business use case, IP availability, and compliance with regional IP usage policies.
• Upon successful verification, additional IPs may be allocated at the discretion of Hexazn.

Allocation of multiple IPs on Windows VPS is strictly prohibited under all circumstances.

4. Client Verification Policy

Hexazn requires all clients to complete identity verification via Know Your Customer (KYC) protocols before or during service activation. All documents must be collected via live mobile camera from the client’s mobile device only. Acceptable documents include:

• National ID (NID)
• Passport
• Driving License
• Clients must also complete phone number verification to confirm their contact information.
• Hexazn reserves the right to request a Trade License or additional supporting documents through ticket or email if required for further verification.

Failure to complete the verification process may result in service suspension or termination without notice.

5. Acceptable Use Policy (AUP)

You must not use Hexazn services for any illegal, abusive, or harmful activities. Prohibited actions include but are not limited to:

5.1 Prohibited Activities

• Spamming & Email Abuse: No unsolicited emails or spam campaigns.
• Malicious Activities: No hosting of malware, viruses, phishing, or facilitating DDoS attacks.
• Illegal Activities: No hosting of pirated content, adult content, gambling, or anything illegal under Bangladeshi/international laws.
• Resource Abuse: No crypto mining, excessive resource use, or poorly optimized scripts.
• Offensive Content: No hate speech, violence, harassment, or incitement of unlawful behavior.
• Unauthorized Access: No hacking, penetration testing without approval, or tampering with others’ data.
• VPN Usage: Use of VPN or proxy services is strictly prohibited. If a user is found using a VPN, the associated service will be immediately suspended and permanently terminated without any prior notice, and no refund will be applicable.
• Streaming Services: Streaming services such as video/audio livestreaming, IPTV, or high-bandwidth media delivery are not permitted on Shared Hosting environments or Shared Bandwidth plans. Clients requiring streaming capabilities on Hexazn must obtain Dedicated Bandwidth to operate such services.

5.2 Enforcement and Consequences

We monitor client activity to ensure compliance.

Violations may result in immediate suspension or termination without refund.

Repeat offenders will be blacklisted.

5.3 Reporting Violations

Report abuse or unauthorized activity to [email protected].

6. Abuse Handling Policy

6.1 Abuse Reporting

Send abuse reports with details (logs, timestamps, IPs) to [email protected].

6.2 Response Timeline

Clients have 48 hours to respond and resolve the issue once notified.

6.3 Consequences

Temporary suspension for unresolved issues after 48 hours.

Permanent termination for continued non-compliance.

Blacklisting for repeated abuse cases.

6.4 Covered Violations

Phishing, fraud, spamming, malware hosting, DDoS launching, copyright violations, illegal content, and resource abuse.

6.5 Appeals

Clients can appeal with supporting evidence. Reactivation is subject to approval.

6.6 Law Enforcement Cooperation

We fully cooperate with Bangladeshi and international authorities when required.

7. Backups & Data Protection

7.1 Backup Policy

We provide complimentary daily backups for shared hosting and VPS, but they are not guaranteed.

7.2 Client Responsibility

Clients must maintain independent backups of critical data.

8. Termination & Suspension

Hexazn may suspend or terminate services for:

• Non-payment.
• AUP or Terms violations.
• Abuse of resources impacting other clients.

No refunds will be issued for accounts terminated due to violations.

9. Limitation of Liability

9.1 Downtime & Interruptions

We are not liable for losses due to:

• Maintenance, outages, or hardware failures.
• DDoS attacks or third-party disruptions.
• Events beyond our control (natural disasters, war, etc.).

9.2 Data Loss

We are not responsible for:

• Client-side errors or negligence.
• Data loss from unmaintained backups.
• Hacking or breach due to weak credentials.

9.3 Damages

We are not liable for:

• Loss of income, business, or reputation.
• Costs incurred from switching providers.

9.4 Financial Cap

Our maximum liability is limited to the last billing cycle's service fee.

10. Support

10.1 Availability

Our support team is available 24/7 via live chat, ticket, phone call, and email.

10.2 Scope

Support is limited to Hexazn-provided services. We do not support third-party apps/scripts.

11. Modifications to Terms

Hexazn reserves the right to update these Terms at any time. Clients will be notified of major changes.

12. Governing Law

These terms are governed by the laws of Bangladesh. Any disputes will be handled in Bangladeshi courts.
